These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Deliveri Inc. (“Deliveri,” “we,” “us,” or “our”), including our website, software platform, shipping tools, integrations, and any related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and all applicable laws and regulations.

Types of Personal Data We Collect & How It Is Collected

Deliveri collects and processes various types of personal data to facilitate our Services. This information is provided by you directly, collected through automated tracking, or obtained from third-party integrations.

1. Scope of Services
Deliveri is a shipping technology platform that facilitates shipping label creation and order fulfillment through integrations with third-party carriers (e.g., USPS, UPS, FedEx, DHL). Deliveri does not itself transport packages or guarantee delivery. All shipping and liability responsibilities lie with the selected carrier.
2. Account Registration and Responsibilities
You must be at least 18 years old to create an account. By registering, you agree to provide accurate and complete information and maintain the confidentiality of your login credentials. You are solely responsible for all activity conducted through your account.
3. Fees, Payments, and Return Labels
All fees are billed through Stripe unless otherwise specified. By using our Services, you agree to Stripe’s payment terms.

Deliveri may apply per-label fees, subscription charges, or usage-based pricing depending on your plan.

Return labels are charged only upon use and will incur the original shipping fee plus a 3% administrative surcharge.
4. Refund and Adjustment Policy
Refunds for unused or canceled labels are subject to each carrier’s refund policy and billing cycle.

USPS refunds: typically processed within 1–2 business days.

UPS, FedEx, and DHL refunds: processed per carrier timelines (generally 10–15 business days).

All refund requests must be submitted within 30 days of label purchase. Deliveri reserves the right to deny late or incomplete refund requests.
5. Carrier Services and Third-Party Disclaimer
Deliveri uses third-party platforms, including carriers, payment processors, and commerce tools. We are not responsible for outages, errors, or service-level failures in these systems. Carrier delivery guarantees, insurance handling, and claims processing are governed solely by each carrier’s terms of service.
6. System Access and Downtime
Deliveri strives to maintain 99% uptime but cannot guarantee uninterrupted access. Planned maintenance, system updates, or external outages may impact availability. You agree that Deliveri shall not be held liable for service interruptions, data loss, or indirect damages resulting from platform unavailability.
7. Acceptable Use and Zero Tolerance Policy
You agree not to use Deliveri for unlawful, fraudulent, abusive, or misleading activity.
Violations—including shipping prohibited materials or falsifying shipment data—will result in immediate account termination under our Zero Tolerance Policy. No refunds will be issued for accounts terminated under this policy.
8. Insurance and Claims
Insurance is optional and subject to Deliveri’s Insurance Coverage Policy. Self-insured shipments are covered up to $500 with a 4% claim processing fee. Claims must be filed within the required timeframe and include all supporting documentation (photos, receipts, tracking data). Deliveri is not responsible for claims denied due to user error or insufficient documentation.
9. API Use and Automation
API access is subject to fair use limits. Deliveri may restrict or throttle access in the event of abusive behavior or system stress. You must not use the API to scrape, replicate, or interfere with platform operations or other customers’ data.
10. Intellectual Property
All Deliveri trademarks, platform code, interface elements, and content are proprietary to Deliveri Inc. or its licensors. You may not reproduce, distribute, or modify platform assets without written authorization.
11. Limitation of Liability
Deliveri’s total liability is limited to the fees you paid in the 30 days prior to the event giving rise to the claim. We are not liable for any indirect, incidental, or consequential damages, including lost profits, shipment errors, or third-party service failures.
12. Modifications to These Terms
Deliveri may update these Terms at any time. Notice will be provided via email or platform alerts. Continued use of the Services after changes constitutes acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to bring claims in court or as part of a class action.
